FEMFI (Far East Maritime Foundation, Inc.), FOR CLOSURE - MTC (Maritime Training Council)

As i have read, MTC will be suspending or closing FEMFI Training Centre. With this occurrence, certificates issued by FEMFI might be considered invalid.

I'll be updating this issue further as I'll read through more of the news.

For those who have broader and/or more knowledge on this, let's discuss for the information of all those who are onboard and those who haven't read or heard about this (especially for those who are holding FEMFI certificates).

A paragraph form the Resolution

One paragraph reads;

Arguing that there was misrepresentation on FEMFI's part when it applied for accreditation with MTC, PNTC Colleges filed a complaint for revocation of accreditation against FEMFI before the MTC,for violation of MTC Resolution No. 3, Sections (blah, blah, blah...), series of 1998, in relation to MTC Resolution No. (blah, blah, blah...), series of 2000, praying that (1) the accreditation of FEMFI's course program be suspended pending investigation, (2) the accreditation of FEMFI be revoked, and (3) the certificates of completion issued by FEMFI to seafarers be nullified for being void ab initio.

during the process, there were resolutions passed and denied, then passed again..

but the final paragraph from the resolution coming from the Office of the President (RP) reads below;

WHEREFORE, premises considered, the Motion for Reconsideration of FEMFI is hereby DENIED. Let the records of the case be transmitted to MTC for its appropriate disposition.

SO ORDERED.

aw grabe naman yan ibig sabihin kukuha na naman ako ng gtf nito?? amfufu naman haizt.. buti nalang napaupgrade ko na kaagad yung coc ko at di pa ko nag training ng stct haaaayyyy!... ..

ano ba nangyari ano ba nagawa ng far east? bakit invalid na certificate na galing sa kanila?

To all Dux,

Upon reading the above statement, I quickly searched what AB INITIO means.

According to the Wikipedia, ab initio means:

"as a legal term: refers to something being the case from the start or from the instant of the act, rather than from when the court declared it so. Example: A judicial declaration of the invalidity of a marriage ab initio is a nullity."

If this is what is meant by the MTC ruling, then this certainly is a big blow to all seafarers who hold FEMFI certificates. I hope that they will further clarify it.

CM Sangalang newspaper article about this dilemma

Sa nabasa ko sa "Buhay MARINO Dyaryo", PNTC Colleges ang ng sampa ng rekalamo.. how it all started eh hnd ko po msyado maintindihan.. super technical din kasi ung copy ng resolution na nka post sa newspaper.. pang abugado Sad dko po maipaliwanag..

I would like to quote few paragraphs of CM Sangalang of Golden Success who is as well writing an opinion at Buhay MARINO Dyaryo, Feb 2009 issue;

>> Bagama't pinag-aaralan daw ng MTC ang mga parameters para sa re-application ng FEMFI, hindi ma-i-aalis sa hanay ng mga marino ang magpanic at mangamba kung ano ang kahihinatnan ng kanilang Far East issued certificates.

Katuwiran ng mga marino, paano nalamang ang mangyayari sa kanila kung sakaling magkaroon ng surprise inspection sa Port State at makitang mula sa Far Easr ang knilang mga sertipiko? Paano nila maipapaliwanag sa maritime authorities na valid ang kanilang certificates gayong sa simula't simula pala ay mayroong legal problem ang nasabing training center?

Bago pa man pumutok ang balita, nauna naming nakapanayam si MTC Acting Director Noriel Devanadera at nahagingan nming mula sa kanya na sakaling ipatupad ng MTC ang kautusan ng OP, kinakailangan lamang daw na hindi dapat o sa ano mang pamamaraan maapektuhan ang mga marino sapagkat mananatili aniyang valid ang Far East issued certificates ng mga ito.

Ngunit mga parekoy, ano pa man ang maging paliwanag ukol dito ay malinawanag na tainted o nadungisan na ang kanilang training certificates. Ika nga ng isa nating nakausap na abogado, walang ipinagkaiba sa isang nilagdaang kontrata ang kaso ng FEMFI na dapat aniya'y binding sa simula't simula ang nakapaloob sa kontrata. At gaya ng Articles of Incorporation na siyang ugat ng reklamo ng PNTC College, lumalabas na simula pa lamang ay may pagkakamali na at sana'y na-ituwid ng mas maaga.

Further, wala pa namang inilabas na order and MTC. so hindi pa po sure if ma-invalid ung mga certs na naissue na.. or ung incoming certs na lng..

As far as i know po kasi, operating parin ang FEMFI kahit my mabigat silang kaso. But most companies now is not patronizing FEMFI anymore.

So far ang masasabi ko lang jan ay ganito. Kahit magsara ang FEMFI ngayon ay dapat hindi pa din magamba. kung ikaw ay may mga training na nakuha sa FEMFI before nangyari ang kaso valid pa din ito. pero kung may mga training ka na nakuha tapos on going na pala ung kaso or meron ng kaso ang FEMFI nung panahon ng iyong pagkuha maari itong magkaroon ng problema.

Kung PSCO naman ang pinaguusapan siguro hindi namn sila ganun kahigpit kung ang mga titignan nila ay ang COC/EOC mo dahil noon pa man ay meron ka na ng mga certificate na ito na narecognized na din ng ibang bansa. at kung ako naman ang PSCO mas mabuti pang tignan ko nalang ung NAC ng particular training. at sa ngayon hindi ganun kahigpit ang mga PSCO sa ibang bansa pwera USA.

un lang ang masasabi ko ayon sa aking nasagap sa mga kinauukulan. pirat
